What Is Probate?

Probate is a court-supervised legal process for reviewing the assets of a deceased person and determining the inheritors, by validating the Will, taking inventory and appraising assets, settling debts and taxes, and distributing remaining assets according to the Will. If there is no valid Will, assets are distributed according to state laws.

How Long Does Probate Take?

Probate requires a minimum of six months to a year in probate court, so that creditors and other issues have an opportunity to be heard. It can take significantly longer, depending on the complexity.
