Probate is pricey, at least pricier than a Trust set up to avoid probate:
Court Costs: There are court costs and a requirement to publish a notice in a local newspaper three times.
Appraisal Costs: There are appraisal costs paid to an experienced and knowledgeable County Probate Appraiser. All assets need to funnel through the County Probate Appraiser—not be appraised by your local realtor or friendly local appraiser.
Statutory Legal Fees: The legal statutory fees are established in the Probate Code based on the value of the estate. For example, statutory legal fees for a year in court will run $23,000 for a $1.0 million estate.
Add in the time incurred—typically around one year—and it is a lengthy and expensive process.
